1. Scope
These Terms and Conditions apply to all orders placed on this website by customers, whether individuals or legal entities, domiciled in Switzerland. Dealhair SA reserves the right to amend these Terms and Conditions at any time; the version applicable is the one in force at the time the order is placed.
2. Offer and Conclusion of the Contract
The products presented on the website constitute an offer for sale subject to availability. The order is confirmed by a summary email sent to the customer after payment has been validated. The sales contract is deemed concluded upon receipt of this confirmation.
3. Prices
The prices displayed are stated in Swiss francs (CHF), including all applicable taxes (VAT included). Delivery charges, where applicable, are shown separately before final confirmation of the order.
4. Payment Terms
Payment is made by bank card through our secure payment service provider at the time the order is placed. The order will only be processed once payment has been confirmed.
5. Delivery
Deliveries are made exclusively within Switzerland. Delivery times indicated when placing the order are provided for information purposes only and may vary depending on product availability and the carrier.
6. Right of Withdrawal
Irrespective of any legal obligation, Dealhair SA grants customers a voluntary withdrawal period of 7 days from receipt of the order, applicable only to products returned sealed and unopened. Return shipping costs are borne by the customer. This voluntary right of withdrawal is granted in addition to, and without prejudice to, the statutory warranty rights described in Section 7 below.
7. Warranty and Defects
If a product is found to be defective, Dealhair SA offers, as a commercial service, an expedited exchange or refund within 30 days of receipt of the product, upon simple notification of the defect.
This service is in addition to the customer's statutory warranty rights under Articles 197 et seq. of the Swiss Code of Obligations (CO), which remain fully reserved and are neither reduced nor limited by these Terms and Conditions. In accordance with Article 201 CO, customers are requested to report any defect as soon as it is discovered, without undue delay, in order to facilitate the processing of their claim.
8. Liability
Dealhair SA accepts no liability for damage resulting from the use of a product contrary to its intended purpose or the instructions provided. To the extent permitted by law, Dealhair SA's liability shall not exceed the amount of the order concerned.
9. Applicable Law and Jurisdiction
These Terms and Conditions are exclusively governed by Swiss law. Any dispute relating to their interpretation or performance shall fall under the exclusive jurisdiction of the courts at the registered office of Dealhair SA, subject to any mandatory statutory provisions applicable to consumers.
10. Final Provisions
Should any provision of these Terms and Conditions be found to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.
